RE: The tariff classification of woven polyester/metallic mesh from Korea.

Dear Ms. Norlie:

In your letter dated February 17, 2009, you requested a tariff classification ruling.

The submitted sample is identified as pattern "Woven Poly Mesh". It is composed of 84% polyester filament yarns and 16% metalized yarns. The fabric is a dyed plain woven mesh. It will be imported in rolls of 21 inches x 15 yards. Your correspondence indicates this fabric will be used as a wrap for fresh flowers and bouquets. The applicable subheading for the fabric, Woven Poly Mesh, will be 5407.92.2010, HTSUS, which provides for woven fabrics of synthetic filament yarn, including woven fabrics obtained from materials of heading 5404, other woven fabrics, dyed, other, mixed mainly or solely with artificial filaments or metalized yarn. The duty rate will be 14.9 percent.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
